Terms and conditions.
The terms of counselling, mediation and training services, and of requesting an appointment and paying fees on the website.
1. The service provider
The service is provided by Mária Babity, counselling psychologist, mediator and skills trainer (registered office: Pécs). Contact: babitymaria.pszichologus@gmail.com.
The website: the public site available on the domain in force at the time, where you can find information, request an appointment, and — for fee-paying services — pay online.
2. Scope of the Terms
These Terms and Conditions (Terms and conditions) apply to psychological counselling, individual skills development, couple and family counselling, mediation, and trainings and workshops ordered through the website, by email or by telephone.
By submitting the form, accepting the appointment or paying the fee, you declare that you have read and accept the Terms and Conditions. The fees in force at the time are fees set out there.
3. Nature of the services
Psychological counselling is mental-health, self-knowledge and personal-development work. It is not medical, psychiatric or clinical psychological care, and it does not replace healthcare treatment. If it becomes clear during the process that another type of care is warranted, the counsellor may close the process and refer the client to the appropriate professional.
Mediation is a voluntary, structured conflict-management process. The mediator does not decide in the parties’ place and does not provide legal representation. Mediation may begin only if every party concerned consents to it.
The topics, duration and group size of trainings and workshops are case by case; the exact terms are recorded in the discussion.
4. Contract and appointment
Sending the appointment-request form constitutes a request for an offer. The contract is formed when the service provider confirms the appointment, or — for a first session that requires a fee — when the fee has been successfully paid through Barion and confirmation of this is received.
For the first session of psychological counselling and individual skills development, immediate payment is required on the website. Mediation, training, couple and family counselling, and general enquiries are made without a fee; for these we arrange the fee and the appointment afterwards.
Sessions may take place in person in Pécs or — by agreement — online. An online session requires a stable internet connection and a closed, undisturbed setting; ensuring these is the client’s responsibility.
5. Fees and payment
The fees for the services are set by the fee list and — in the case of mediation and training — by the individual offer. Prices are in forints and include the VAT in force at the time, if the service provider is VAT-registered.
Online payment takes place on the secure payment interface of Barion Payment Zrt. The service provider does not store card details. The system sends confirmation of a successful payment; the invoice is issued through the Számlázz.hu system, based on the billing details provided.
If payment is not completed, the appointment is not regarded as booked. The fee covers the confirmed session; the service provider does not reimburse other costs (travel, technical equipment).
6. Cancellation, change, non-attendance
An appointment may be cancelled or changed by email at least 24 hours before the session begins. In that case we carry the fee paid over to the next jointly arranged session, or — if no new appointment is made — we refund it.
If the cancellation arrives within the 24-hour deadline, or the client misses the session without prior notice, the fee remains with the service provider as consideration for the reserved time. If an obstacle arises on the service provider’s side, we offer a new appointment or refund the fee.
The cancellation terms for mediation and training may also be recorded separately during the discussion, if the process involves several parties or a room booked in advance.
7. Withdrawal from a distance contract
As a consumer you may, as a general rule, withdraw from a distance contract within 14 days without giving reasons. This right does not apply if performance of the service began before the deadline at your express request, or if the contract concerns a session on a specified date and the session took place within the 14-day period.
Please indicate your intention to withdraw in writing, to the email address above. We complete the refund after the request arrives, by the method used for payment, provided the withdrawal is lawful.
8. Confidentiality
What is said during counselling and mediation is confidential. The service provider’s duty of confidentiality admits exceptions only in cases set out by law (for example suspicion of a crime, endangerment of a minor) or with your written consent.
The processing of personal data is governed by the privacy policy sets them out in detail.
9. Liability
The service provider acts according to professional rules and the care that can reasonably be expected. It accepts no liability for the consequences of the client’s decisions, for the conduct of third parties, or for interruption arising from a technical fault in the online connection, if that is not attributable to the service provider.
The information on the website is general in nature and does not constitute individual advice.
10. Complaints and dispute resolution
Please raise a complaint primarily at the email address above. As a consumer you may also turn to the conciliation board competent for your place of residence or to the consumer-protection authority. Hungarian law governs the contract.
11. Closing provisions
The service provider may amend the Terms and Conditions with the effect published on the website. The amendment applies to contracts concluded after publication; appointments already confirmed are governed by the terms in force at the time of confirmation, unless the change is more favourable to the client.
